Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and ONEUP TECH S.R.L. ("we", "us", "our"), a company registered in Romania, European Union, covering your use of the Mosquito Kingdom game and this website (together, the "Service").

By installing or playing Mosquito Kingdom, you accept these Terms. If you do not accept them, please do not install or play the game.

Your privacy is covered separately by our Privacy Policy, which forms part of these Terms.

2. Your licence to play

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play Mosquito Kingdom on devices you own or control, for your own private entertainment.

You may not:

• sell, rent, sublicense or redistribute the game or any part of it;
• modify, decompile, disassemble or reverse engineer it, except where that right cannot lawfully be excluded;
• remove or obscure any copyright or ownership notice;
• publish a modified or repackaged build, on any store or otherwise.

Recording, streaming and making videos of your own gameplay is welcome and explicitly permitted, including monetised videos.

3. Accounts

You do not need an account to play. The complete game is available as a guest.

If you choose to create one, you agree that:

• the information you give us, such as your email address, is accurate;
• you are responsible for keeping your password and device secure;
• you will tell us promptly if you believe your account has been accessed by someone else;
• you will not share, sell, trade or transfer your account;
• you will not create accounts in bulk or by automated means.

You must be at least 16 years old (or the age of digital consent in your country, if lower) to create an account. Younger players are welcome to play as guests.

Your public handle appears on the leaderboards. Choose one that is not offensive, impersonating, or another person's name or trademark. We may reset a handle that breaks this rule.

You can delete your account at any time from inside the game or at api.oneuptech.ro/v1/account/delete. Deletion is immediate and permanent.

4. Fair play and anti-cheat

Mosquito Kingdom has leaderboards, so progress needs to mean something. You agree not to:

• modify the game, its memory or its save files to gain progress you did not earn;
• use bots, macros, automation tools or emulator scripting to play for you;
• exploit a bug for advantage instead of reporting it (tell us and we will thank you);
• submit fabricated or tampered save data to our servers;
• manipulate the device clock to gain offline earnings.

Our servers validate submitted saves. A save that fails validation is quarantined rather than accepted, and given a support reference. If you think a rejection was a mistake, email us with that reference and we will look at it properly.

Repeated or deliberate cheating may result in leaderboard removal, cloud-save suspension, or account termination.

5. Acceptable use

You agree not to:

• attempt to gain unauthorised access to our servers, accounts or data;
• probe, scan or stress-test our infrastructure without our written permission;
• send automated or excessive requests to our API;
• interfere with other players' use of the Service;
• use the Service for anything illegal.

If you find a security vulnerability, please report it privately to contact@oneuptech.ro before disclosing it anywhere else. We will not pursue good-faith security research reported this way.

6. Game progress and cloud saves

Your local save lives on your device. Uninstalling the game, clearing its data, losing the device or a device fault can destroy it, and we cannot recover it.

Cloud save is a convenience, not a guarantee. We take reasonable care of it, but we do not promise that a cloud save will always be available or recoverable. Where two devices disagree, the game applies conflict rules to decide which save wins, and the losing one may be discarded.

Deleting your account deletes your cloud save immediately and permanently. There is no grace period and no restore.

7. Adverts

Mosquito Kingdom is free to play and is funded by advertising. The game shows:

• Banner adverts — a small strip displayed during play;
• Rewarded adverts — optional videos you choose to watch in exchange for an in-game bonus.

Rewarded adverts are always optional. No zone, boss, upgrade or ending is locked behind watching one, and the game can be completed without ever doing so.

You agree not to interfere with advert delivery or to generate artificial impressions or clicks — for example with automation, click farms, or by modifying the app. Advert fraud is a breach of these Terms and of our advertising partner's terms, and may result in termination.

We do not control which specific advert you see; that is decided by our advertising partner. If you see an advert that is offensive, misleading or inappropriate, please tell us at contact@oneuptech.ro with a screenshot and we will report it.

What the advertising SDK collects, and how to limit or switch off personalised adverts, is set out in our Privacy Policy.

If a rewarded advert fails to load or does not credit your bonus, that is usually a temporary problem with advert availability in your region. We cannot guarantee that a rewarded advert is available at any given moment.

8. In-app purchases

The game offers optional one-off purchases, including removing banner adverts, cosmetic sweeper skins, additional tools, a starter bundle, an increased offline earnings cap, and a "support the developers" option.

What you are buying

• A purchase grants you a limited, personal, non-transferable licence to use virtual content inside Mosquito Kingdom. You are not buying property.
• Virtual items and in-game currency have no real-world value. They cannot be exchanged for money, sold, gifted, or transferred to another account or another player.
• Nothing in the game is required to complete it. All purchases are convenience or cosmetic.

Payment and pricing

• Purchases are processed by Google Play Billing. Your contract for the payment itself is with Google, and Google's terms apply to it.
• We never receive or store your card details.
• Prices are shown in your local currency before you confirm, and include applicable taxes where the store handles them.
• We may change prices or stop offering a product. A change never affects something you have already bought.

Delivery and restoring purchases

• Purchases unlock immediately once Google confirms payment.
• Your entitlements are stored on your device, and also in your cloud save if you use an account, so they follow you to a new device.
• If you reinstall using the same Google account, you can restore non-consumable purchases without paying again.
• Deleting your Mosquito Kingdom account does not cancel or refund a purchase, because the purchase is held against your Google account, not ours.

Refunds

• Refunds are handled by Google Play under Google's refund policy. We cannot process a refund ourselves, because we never took the payment.
• If you are a consumer in the EU, you have a statutory 14-day right of withdrawal for digital content. By confirming a purchase you agree that the content is delivered immediately and acknowledge that you lose that right once delivery has begun, which is how digital goods normally work. Your other statutory consumer rights are unaffected.
• If something genuinely went wrong — you were charged and the item did not unlock — email us at contact@oneuptech.ro and we will help you sort it out, including with Google if needed.

Purchases by children

If you let a child use your device, please enable purchase authentication in the Google Play app so a password is needed for every purchase. Unauthorised purchases made by a child are handled through Google Play's refund process.

If the game shuts down

If we ever discontinue Mosquito Kingdom, purchased virtual items may become unavailable. See section 9 for the notice we will give.

9. Availability and changes

We would like the Service to be available all the time, but we cannot promise it. We may suspend it for maintenance, updates or reasons outside our control.

We may change, add or remove game features, rebalance the game, or change how the account and leaderboard services work. If we ever have to shut the online services down, we will give reasonable notice on this website and, where practical, in the game — and the offline game will keep working.

10. Our intellectual property

Mosquito Kingdom, its name, artwork, characters, mosquito designs, music, sound, text, code and this website are owned by ONEUP TECH S.R.L. and protected by copyright and other laws. Nothing in these Terms transfers ownership to you.

Fan art and gameplay videos are welcome. Please do not present our artwork or assets as your own, redistribute the raw asset files, or use our name or logo in a way that suggests we endorse or produced something we did not.

11. Third-party services

Mosquito Kingdom relies on several Google services:

• Google Play distributes the game;
• Google Play Billing processes purchases;
• Google AdMob selects and delivers adverts;
• Google Play Games optionally signs you in.

Your use of those services is governed by Google's own terms and policies, and Google is responsible for them. We are not responsible for Google's services, and Google is not responsible for ours. What each of them collects is described in our Privacy Policy.

12. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure against every attack, or that any defect will be corrected.

Nothing here excludes or limits your rights as a consumer under the mandatory law of your country of residence, which always apply.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of game progress, data or profits, arising from your use of the Service.

Where liability cannot lawfully be excluded, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or €50.

We do not limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

14. Suspension and termination

You may stop using the Service at any time by uninstalling the game, and you may delete your account whenever you like.

We may suspend or terminate your access if you materially breach these Terms — for example by cheating, attacking the Service, or abusing other players. Where it is reasonable and lawful to do so, we will tell you why and give you a chance to respond.

Sections that by their nature should survive termination — intellectual property, disclaimers, limitation of liability and governing law — continue to apply.

15. Governing law

These Terms are governed by the laws of Romania, without regard to conflict-of-law rules. Disputes fall to the competent courts of Romania.

If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory consumer law of your country of residence, and you may bring proceedings in your local courts.

16. Changes to these terms

We may update these Terms from time to time. The "last updated" date at the top shows when. If a change materially reduces your rights, we will make a reasonable effort to tell you before it takes effect. Continuing to play after a change means you accept the updated Terms.
